6/27/12 -- Here is footage shot yesterday showing the aftermath of the 6/22 police raid of Better Health Group Cannabis Collective on Sonoma Blvd.

Commentary by collective volunteer Morgan Hannigan. According to Hannigan, police shredded voter registration forms at the establishment, covered security cameras, destroyed the digital video recorder, and evidently trashed the premises as well as using threats and intimidation.

why are you trying so hard to shut up the ex-employee the people have the right to know how the NON-PROFIT ORGANIZATION that the sick and poor people are putting their money into have the right to know how the BUSINESS is REALLY running! why should the ex-employee have to refrain from what he want's to say he was screwed ROYALLY by this multi million dollar club not paying him what he is owed and he's just supposed to move on? what about all of the of the point's he was making about screwing the patients moving strains selling expired drink's hash kief to your poor sick ol patients you didn't

Neither Jorge, nor Mila, is involved in operating BHG. The operator of the third raid was eventually named as Jonathan Linares. If you are a disgruntled employee, I suggest you grow up, move on, and think of ways to help patients, as I and others are trying to do. I recommend you look to how you can help your community, and leave the people whom you may disagree with alone, and let them do what they too think is right. I would ask, as a member of the collective, that you refrain from discussing how business WAS run, and rather look to how BHG is trying to help the medical cannabis community
now, i.e. our rally on July 16. Please, as our community is already poorly represented by people with poor grammar, who are easily led off topic, often over emotional, and often misinformed, please, stop talking, or at least stop hiding behind poor pseudonyms, and use your real name.

All the people that worked there were also lazy and uncaring about patients there were only two other people that cared as much as me. One stopped working from being talked **** to all the time and the other still works there but constantly gets in fights or temp fired by the boss
[ie gives him no hours]

For a Patient I would recommend if they ever open back up.
Go in for the free gift and then never come back.

I also just read this "the original founder of the dispensary Jorge Espinoza, who was arrested in the first two raids, is no longer operating the dispensary, but they did not give the name of the current operator."
Surrounding the Raid which Is true in a Sense.

The company is actually under Jorge Wives Name and they do not have the same last name. He is still operating it. Just at a distance.

I worked with this collective for about 1 and a half years.

They have alot of tricks to make you think what you are getting is what it says it is.

This place is Guilty of relableing Jars/Hash/Kief so they sell.
"Oh hey that low grade purple didn't sell let rename it the same strain we just sold out with in High grade so it will Sell Better"

So you may be getting a mostly sativa hybrid when you picked something that was labeled as full indica

They are also guilty of Moving lower grade to a higher shelf C to B Or B to A.

Mixing shake they actually label as a Specific strain
selling said shake mixed with a bit of b grade for 5 dollar joints when the 8th of shake is 5 anyway,

Boss Talks Down to Vendors to get the Cheapest price As this is usually the last place they go.
Eventually some of the best Vendors get wise and just stop coming which is why there are some 1-2 week periods where they have no high grade and just relable the best buds of B to A for that time
But I assure you there is at least 1 Pound of High Grade in the Back that the boss and employees smoke.

I had to sell Expired Drinks, Really Old Hash Oil thats been sitting in the freezer for months
with other food stuffs "ie crumbs"
That I really feel bad for selling but the boss told us to.

Bud on display with hairs in it from time to time as everyone has long hair that works the counter. At least they did when I worked there.

and on top of the patients. The Boss also screwed me over. Not paying for time I worked, Every time someone took off early for the day he asked me to volunteer for a few extra hours for medicine. Every time I worked that at the end of the night he either gave me less then said or not the high grade strain we agreed on. I Have gotten moldy buds from
him.

I actually grew for this collective also. They were supposed to pay me out for the time and money but they only did 2/3 of the payments and my boss tried to bring up an excuse for why it wasn't worth as much as he said originally

Last thing shortly after I got in a car accident last year. He had me as the only employee doing physical work when we moved locations as the other employees were too lazy most of the time or the boss knew I was the only person who would do exactly as told.

I feel very slighted as I was the only person to ever open up on time, Do what he said and to never
steal from him unlike some other employees I wont mention.

[they just got shut down for the third time in the last 6 Months for Federal Raids. and one of the times EDD came there to Check in if everyone was getting workers comp, if the workers were getting paid and how the workers were treated]

personally, after every effort i've made to bring change regarding these policies to vallejo, having been shot down time and time again, i'm leaving vallejo before being shot down for good. it probably only took one officer to shred those documents, but many more stood by and refused to uphold their oath, until Mr. Garman put them on blast. Thanks for shining a light on the issue, my friend, and I hope to help bring change to this town, enough that i will feel safe again in my home. until then, i advise we all put up hidden cameras that they can't cover or dismantle when they come harass you.

I AM A FORMER VOLUNTEER OF ALMOST TWO YEARS AT BHG. i'm not going to lie to you. you can ask me any question. i will answer you honestly. i used to think jorge was just a smart businessman. but i learned within a few months in vallejo that the patients never had enough money for their medicine due to financial burdens completely out of their control (a whole different thread couldnt cover the level of poverty in vallejo). so patients would constantly ask for free medicine. jorge instructed me to never let a patient get to the point where they felt embarrassed to ask. he told me that i
shouldnt be insulted or offended if they ask. just ask them to show proof that they have financial hardships (utility shut-off notices, etc) and put their name on the "compassion" list. you could see the desperation and pain in their eyes every time. unfortunately, they did away with the "compassion" program when all the medicine and bank accounts were siezed during the first raid at 3611 Sonoma back in late February. they no longer had the resources to offer free medicine. it makes me really depressed and i have lost what i thought was undying faith in humanity. these people
were just asking for pain management medicine that they couldnt afford or trying to get their appetite back after chemotherapy due to cancer. and when they did have money they always made sure to donate something useful. for instance, one patient worked at safeway and would bring bags of food to donate to the volunteers as we did not make much and were poor ourselves. im sorry to say there were no "millions of dollars". jorge operated at a loss for months even before the raid. i asked him how he was going to keep the business open if we kept giving out free medicine. jorge told me that
he put every penny he has into the collective, because he believes that he is truly helping people. and that even if it wasnt profitable he wouldnt ever regret it. we would just have to make it work.when i first came to BHG, i was kind of stubborn about paying my back taxes. i told jorge that i owed the government some money in back taxes and they could "go **** themselves". jorge pulled me aside and explained why i should take care of that instead of ignoring it. i just did not expect to hear that from him. i had an image in my head of what his priorities were and boy was i wrong. he
truly cared about my well-being. i just feel like vallejo needs to know who this man really is. he is a loving husband to his wife. i have never seen a man treat his wife with such respect. even when he was super stressed because we werent making ends meet (i remember several times when the power got shut off due to inability to pay the bill), whenever his wife called or showed up, he was never short with her and never let it affect how he talked to her. i learned why hard work is important from him. that was something i never even properly learned that from my parents.

jorge is truly a good person is that he takes the time to educate anyone who doesnt understand the law pertaining to their rights as patients. thats why all patients at better health know they arent breaking the law and arent afraid to fight for their right to medical treatment. that is also why certain vallejo officers are going to quit. I'm talking to you, Little Nichelini.
I'm pretty sure Nichelini was the one who tore up an 18 year old girl's voter registration form (which was completed and ready to be mailed). he was sitting at that desk illegally logging in to patients email accounts
(the browser saved their passwords in the auto complete field). during the last raid, officers were answering patients phones without their consent and impersonating an african american accent, using slang and profanity, spreading rumors & slandering the owner of the phone to the caller on the other end. the surgical gloves were put over the cameras by the female officer who was present and by a couple of the male officers as well. i believe there were 3 or 4 cameras covered with surgical gloves in order to hide the evidence of the officers trying to cover their tracks while stealing the
security DVR. what they didnt know is that there is a 2nd Security DVR that is wireless inside the building. so we have redundant proof of their misconduct after the initial proof (which was stolen). that means that all the **** they did after they thought they were safe was actually recorded. very stupid guys. these videos will be going up on http://www.betterhealthvallejo.com and the youtube channel for better health group of vallejo

I am/was a member of bhg and I've been there many times to get compassion (free medicine). They knew of my financial problems and my medical problems. They were sure to get me the right medicine when I needed it whether I had anything to donate or not. Maybe the owner used the compassion program for patients with true pain and get a true medical benefit from the medicine and let the people that had no real medical reason for the make more donations. Every time I walked in I was greeted with a smile and asked me about my condition and how the medicine was working. This was a true collective
that had compassion by supplying quality medicine at an affordable reimbursement and worked with everyone that needed assistance. The greedy are taking over this town and they seem to not care about the patients anymore....it's a truly sad story. I ran into a volunteer yesterday and he gave me a flyer for a protest and he told me they have closed their doors for good. I'm sorry guys, I wish you all well and I will be supporting you just like you helped me.

I was glad to see that they changed their website to a VPD activism website to keep their patients and supporters updated on events
scheduled for later in the month in Vallejo.

The fact that medical marijuana was being dispensed from this business had nothing to do with this raid... sort of ... All of the raids that have occurred in Vallejo have occurred to serve a "Search Warrant"! A search warrant looking for illegal drug activity. I'm not aware of any police policy that instructs officers to cover cameras and destroy paperwork during a search warrant. The charges stemming from these "searches" have not covered any illegal drug charges. In fact, no state or federal charges have been filed pertaining to ANY of the MMD police raids.

I have walked around all the clubs in town to try to obtain help (free medicine) becouse of financial toubles. better health group and 1 other clubs were the only ones

I urge every patient or supporter to go to the police department and file a department complaint on the behalf of Better Health Group. This can not and will not be tolerated. Californians have fought for this medicine for years and the citizens of Vallejo have spoken by passing Measure C. They are taking away safe access to our medicine. This is not only Vallejo's problem, its also the bay area, and the state's problem. This is our time to show them how organized we are.

@ Salty Dog: I thank you for your comment. Yes, an apology is definitely warranted to the establishment. It is very disconcerting to read what the Vallejo police has done during this raid. They are making it extremely difficult to gain the community's trust. The family of Guy Jarreau has lost all trust in the Vallejo Police Department. Placing gloves over cameras, destroying voters' registration forms, etc...remind me of how the Vallejo police destroyed the video footage of Guy Jarreau being shot. Now, they say they can't find it or it doesn't exist. There's corruption going on and

Also of note: According to Morgan Hannigan, police disabled the security system (burglar alarm) in the previous raid going as far as prying open the locked metal box where the brains etc. of the system were housed and ripping out the electronics. I have video of the condition of the security system, but didn't include it because it is supposed to have happened prior to this raid.

The Vallejo Police Department is corrupt! Chief Nichelini is only a part of the problem. The police department corruption has grown to it's cuurent level since City Manager Keen has taken over.

Daniel Keen has stated a personal aggenda against all medical marijuana businesses when he was City Manager of Concord. His first month as City Manager of Vallejo saw our first MMD raided and closed. This wasn't a coincidence.

Vallejo's City Manager does not have the right to set "City Policy" with regards to ANY business. But, to set a policy to raid, destroy and close all MMD's in Vallejo
is criminal. As a resident and tax payer of Vallejo I can not condone any policy that places the City in legal jeopardy.

Medical Marijuana is "decriminalized" in the State and any interference by law enforcement has been met with fines and criminal charges.

Costa Mesa is currently fighting law suits stemming from a police "raid" on an MMD that currently has cost the city more then $400,000.00.

Vallejo is headed for another bankruptcy because of the actions of our police department. Who will take responsibility for those actions when the law suits start coming? Perhaps
Nichelini's retirement was expidited because of those pending law suits...

If you view the video a few times you will find numerous Laws were broken one of wich was HIPPA (health insurance protection and portability act) this Law requires a high level of confidentiality for all Patient medical information this even includes viewing Patient info if the PD acessed
these records then flung them around willy
nilly this is a major HIPPA violation and could be subject to large fines and or prosecution . The EDD connection is a real stretch (were the other enforcement agencys too busy to play )the MO shows
this was planned harasment.

The collective encuraged everybody to register to vote they have done that since last year and its an ongoing campaing to encourage people to get to the voting polls and joust vote not any especial campaing if u see in the video there is a section dedicated to voting

"Pick The Battle" makes a salient point. Video is, increasingly, becoming a verification tool for both sides of the law enforcement vs. public relationship. Cops can use video to show context and arrestee behavior leading up to or during an arrest. Defendants, can also use surveillance video to show abuses or violations of one's rights. Covering the cameras is bee ess. Using modern applications, if an undercover officer's face needs to be fuzzed out, well then okay, do that to protect identification until a court rules otherwise. But to cover the cameras and bust up the DVR just stinks
out front. If anything, a smart police department WANTS video to establish proper conduct during a search, and show that defendants rights were protected. This conduct is ignorant, from a liability standpoint. And, yes, the City of Vallejo pays liability insurance, which all comes from us, the taxpayers. If memory serves, "We" just paid out, via insurance a 4 million dollar settlement, no?

The most important thing is to restore PUBLIC CONFIDENCE to law and order.

CM should take this incident as an opportunity and investigate and take appropriate action to set a new tone for VPD and restore public confidence.

Many of the things said/suspected was hard to prove even if it is true (e.g. verbal threat..it is he says vs. she says and police has advantage here ...) so let us focus on things that is NOT DISPUTABLE:

1. Destroying voter registration.
2. Rubber glove on camera and destroying DVR.

Folks, we need to pick the battles that we know we can win and put all our force behind
it.

The above two are what I see with clear evidence that can prove beyond doubt.

Based on what we have seen in this video would certain cops intimidate a civilian? Would certain cops destroy evidence as this would explain why the video tape of that particular shooting was never returned (he was filming an anti-violence documentary at the time).

Based on
other historical facts, would Police and Fire personnel post on the blogs private information about an emergency call they made to Councilmemeber Gomes and her husband Tony Pearsall's home? Would certain cops or firefighters tear down campaign signs or vandalize homes of certain candidates?

Would certain Police or Fireman make statements like they did to Marc Garmen "this will get real on the street" or other threats on the blogs "I hope you never dial 911" to citizens that raised the slightest questions about Public Safety. Would certain public safety union members threaten
sitting council members as was alleged by the late Pete Rey against Kurt Henke? Would Police shoot a family dog in cold blood? The actions above leave me no choice but to conclude that the answer to all of the above is "yes".

There was a time, not long ago, when I believed your call for justice for Guy Jarreau just a bit over the top...and said so. But then, that was when I believed that the social contract between the public and the "authority" was in tact.

After this brazen display of buffoonery, that belief is looking pretty weather worn, and, in fact, that is the important message here - all other civic issues and wishes and cares and woes are left in the dust if confidence in those sworn to uphold the law is diminished.

There is an apology required by the new Chief, restitution for damages, and
justice for Guy Jarreau. Nothing less will restore my confidence in local law enforcement.

This type of behavior by the Vallejo police doesn't surprise me...AT ALL!!! They destroyed video footage of the shooting of Guy Jarreau by Vallejo police officer Kent Tribble. None of the video equipment was ever returned to its rightful owners! This behavior is unacceptable!!! Complaints definitely need to be filed! Threats and intimidation?!?! Really?! This is good information...And, justice for Guy Jarreau continues!

This is a disgusting police department, supported by a disgusting city government, which includes ALL council members and Keen. A council member told me that it would be inappropriate for him to criticize the chief; that's not the member's role. I'd just like to find a council member with character sufficient to say, "THIS IS WRONG!" I don't know if it's "illegal," but I know that arresting people doing no harm and destroying their property is just plain wrong. and sworn code of conduct -- from all of the ones serving (yes serving ) this means all of the SWORN OFFICERS ... otherwise we could just as well hire a bunch of the

Amazing video, and what could have been another video was blocked by the police putting rubber gloves over the security cameras. This action alone should be highly illegal for them to do as they should be able to be photographed anytime and anywhere they are making any kind of arrest or raid. Why are the police so fearful of having their raid videotaped? Of course it is because they should be sued in court for their actions. Destroying voting registration forms? Again highly illegal! Whoever participated in this raid needs to be fired! We do not need a group of Nazi type police in our city! I
am very upset after viewing this video and hope that this makes its way to be shown to the Council!

I actually thought these kinds of police actions had stopped in Vallejo. The City Manager, Dan Keen, is going to "investigate" this? That's funny. Dan Keen, in the first month he was on the job here in Vallejo, sent a message to the City Council insisting that the "raids" should continue. This was in response to questions from the Council concerning the first raids by the police back in Feburary.

Dan Keen is directly responsible for the day to day "running" of the City, per the City Charter. Dan Keen is Police Chief Nichelini's direct supervisor.

There is currently
a City/Police policy in effect directing these police "raids" and the actions taken by the officers involved.

Who is responsible for this policy, when was it established and who authorized this absurd policy should be everyone's question. Did Dan Keen, Chief Nichelini, Mayor Davis and/or the City Council authorize this policy? Or are they all responsible for this policy by their inactions?

It's time for all of us to let our Council know that we will not allow our City to become a "police state". We will not allow our "hired" City workers to use their power to
over-ride Council decisions and popular vote.

Is this really as it appears? A Police Chief closing legitimate businesses because he doesn't like what them? Something tells me it goes a bit deeper then that.

The city manager said he "determined the Police Chief needs to have the trust and respect of the elected officials and the confidence of
the entire community."

"We need to move forward with a police chief that all the citizens of Sanford can support. I have come to this decision in light of the escalating divisiveness that has taken hold of the city,"

Even though this is about a police chief, I think this approach
should apply to all police working for the city.

Let us start a new era.

Did any of those involved in the raid wear a camera? Since the City now has a significant number of cameras for officers to wear it will be telling if no officer wore one.

I have been involved in large layoffs. In my experience no representative from EDD (Unemployed) ever showed to make sure we were properly covered etc.

I appreciate that there is ambiguity regarding marijuana laws; there are questions concerning jurisdiction and God knows there is no consensus regarding the efficacy or safety of marijuana use.

On the other hand, there is a significant number of individuals who find relief from real medical issues through marijuana use and through a process that has been established as legal in California. These are the people who likely cannot afford or are simply not in a position to receive medical insurance. They are, of course, the least able to fight back.

But what
you did personally to the gentleman in the above story and what you did to his establishment is nothing short of legalized thuggery and you all should be soundly ashamed of the bullying outcome.

I was led to understand that this was a country of laws and a faith in the good will of citizens. I actually was becoming enured to the notion that the police force in this little hamlet was carrying a bad rap load, given its reduced forces and high incidence of illegal activities. Not any more.

You owe that gentleman a full blown apology for the manner in which you conducted yourselves along with
restitution for the damages you caused. You cannot easily replace his confidence in law and order.

As for the city Council- I hope they will not sit by idly - they should be screaming bloody murder over this incident. You are their employees. And your salary is paid by me, the taxpayer.

And I want better use of that money.

Whatever one thinks of Medical Marijuana, by Morgan's comments, one can see that the collective was endeavoring to follow applicable laws by conforming to building inspections and such. Obviously, this raid is no coincidence, and the officers involved targeting comments towards Morgan regarding his public appearances. That's the really troubling part, the use of force, using the uniform as a threat tool, hiding behind the badge. Pretending to uphold the law but acting like a small town sheriff, throwing their weight around. Trashing premises is NOT called for, if they must conduct the raid,
seizing the paperwork and on-site cannabis would be the ONLY thing necessary. The covering up of cameras, and destruction of the DVR is pure straight up thuggery, indicative that they KNEW they were working outside the lines. So, Chief Nichelini's gee-shucks appearance last week at the Public Safety meeting now REALLY stinks, as he's giving us the finger on his way out, and condoning this behavior. Enabling a-hole. The City Council last night asked the City Manager to investigate this after Morgan spoke during community forum. I so hope these cops are busted for this. Absolutely unacceptable.
