Kurshan under investigation

According to the Solano County District Attorney, failed Vallejo political candidate Sam Kurshan is currently under investigation for perjury in connection with his unsuccessful attempt to recall Vallejo Councilmembers Stephanie Gomes and Marti Brown, specifically relating to voter registration and other sworn statements made by Kurshan. The lead investigator on the case was unable to comment on the specifics as the investigations are ongoing; however, the matter has been assigned case# 12-0667 by the DA.

If Mr. Kurshan is found guilty of perjury, he could face as much as $10,000 in fines and/or up to four years in prison.

It seems to me that "the birds of a feather" analogy is appropriate with this scandle. The VFD is a mob of overpaid, self serving drunks who prey on the publics sympathy after 911. Sam is a loud mouth, rude and obnoxious little man who wants to run with the big dogs, but doesn't have a bone...just a bark. Isn't it funny that the Vallejo Times Herald will publish whatever the VFD wants them to? I see the articles Captain Sarna's two sons published very differently...the article on the one who was arrested for attempted murder doesn't mention his well know family or that is father is Vallejo Fire Captian Dan Sarna. But Three days later there is an article on the front page about the other son (pictured w/ proud dad) is following in his fathers footsteps. Vallejo Times Herald: Where is the follow up on the first story? Hey Sam: Tell us what you were doing behind the scenes to discredit the councel members!

All hours spent by legal, city clerk, and the Registrar of Voters office for all five failed attempts to recall the elected representatives. Then we can talk about how unimportant his perjury was.

It is really concerning when you consider the fact that people on the legal payroll are trying to discourage citizens from taking action to report someone who is a flagrant law breaker. Fact Checker   |October.27.2012 Momster You admit a case number is assigned when it has merit.So the DA must feel merit exists. How do you know the complaint was rejected by the Registar of Voters? Remember that word assume. People have a right to Recall efforts. But they dont have the right to commit perjury.

momster   |October.27.2012 People submit referrals and, if merit, the District Attorney files the Complaint. All referrals have a case number until a Complaint is filed where a Court case is given. Anyone can submit a referral or request for investigation to the District Attorney's Office. If the issue was already rejected by the Registor of Voters then chances are it willalso be rejected by the D.A.'s office. This is frivolous! I'm sure the Solano Judges are getting tired of seeing your group taking up space, time, and money in their court room. Citizens have a right to recall..and should not be feared prosecution by the governmant for exercing their rights. This will go nowhere "NO COMPLAINT."

wendy   |October.25.2012 I regret that Kurshan denegrated and insulted so many good people in town this was relentless and a concious decision by him , when he decided to run for Council he temporarily cleaned up his act and apologized to many for his behaviour and insults . He behaves when he wants something , this shows how childish he really is but even a child is scolded when they are caught with their hand in the cookie jar . His actions are selective and premeditated and keep in mind he did not act alone and if forgery is implicated his goose will be cooked . do you think the folks at County jail will throw him a welcome back party with his favorite spam loaf ? .

Clearly, the gentleman has demonstrated in spades through his words and past actions that he is not rational and very likely in need of mental health intervention for his protection and the protection of those legions whom he perceives as an "enemy". Fining him or jailing him is not a permanent solution to the misery and outrageous accusations that he has spawned and that he perceives as an accurate reflection of reality. On the contrary, all this only reinforces the paranoia that appears to have taken up permanent residence in his tortured existence. I would prefer to see a judge order a psychiatric evaluation to determine strategies to help this tortured sole.

Being a malicious troll bent on people's destruction isn't illegal. But lying on a document where you swear to tell the truth ... finally crossed the legal line. Voter registration fraud is particularly despicable because it gets at the very heart of our democracy. How dare this man try and lie his way into recalling two council members who were the highest vote getters in their election (and Spammy was nearly last) and who have done nothing wrong but take positions he doesn't like. Just getting a bona fide DA investigation into this cheat and fraud is justice. Trying and convicting him would be sweet, sweet justice indeed. Couldn't happen to a worse person.

His use of intimidation of private citizens by publishing their names, attempts to humiliate or bully by divulging personal information, or by posting fictitious gossip are all attempts to deflect the attention away from himself. It now appears that his actions may be illegal as well, as some have always suspected. Bottom line, he has no boundaries, nothing is too vile for him and it may have finally caught up with him. Not True Sam   |October.25.2012 Dispute the fact that you are well acquainted with the DA and the criminal aspect of the law, the DA's office only assigns case numbers to cases that they will be investigating. If the facts didn't have merit, they would have simply dismissed it and in that case, not assigned a case file number to it. And Sam, I remember that you claimed to have filed a complaint with the DA against Gomes and Brown alleging harassment. Did your case have a number assigned to it?? No didn't think so. Why? Because it was without merit. Now your allegations could prove to be problematic for you because that may be a case of defamation. If you did nothing wrong, if you didn't lie, then you have nothing to worry about. Right?

Anonymous   |October.25.2012 Despite what Garman wants people to believe, there were no problems with any of the forms filed with the FPPC and just for the sake of this conversation, even if there were, the flexibility the FPPC has allows for forms to be amended, just like an IRS return after it has been submitted.

Elimax   |October.24.2012 Marc, Did you file the complaint that the DA is investigating? Simple question, needs a simple answer. If no, then your write up is acceptable. If YOU were the person responsible for filing a complaint and the subsequent investigation is being reported by you without disclosing those facts, then you have made a pretty good error in your judgement. Anyone can file a complaint. All complaints will be investigated and given a case number. It's a simple CYA by the DA's office. Again, fair reporting would have said that you would disclose the fact that the "news" you were reporting on was created by your own complaint. If the above is the case (which I don't know it to be) then a more accurate headline would have been something along the lines of "VIB Editor Marc Garman files Perjury complaint against Sam Kurshan with the DA's Office...." So should we be concerned about your journalistic integrity?

Anonymous   |October.24.2012 Not only will this so called investigation go nowhere, Garman the wanna be Sherlock Holmes who has a history of filling in the missing facts with assumptions has made himself legally liable this time. I worked on the recall with Sam and he did nothing illegal. He did not lie concerning any voter registration issues nor did he lie about any recall issues. The Solano County Registrar and the City Clerk of Vallejo accepted and approved every related form which at the time was challenged by Garman AND WENT NOWHERE. But Marc couldn't accept that so he filed a complaint with the DA. All complaints are assigned a number, to reference them by. This means absolutely nothing which will be borne out over time. But this time Mr. Garman will have to answer to a Civil Court Judge when Mr. Kurshan brings his case against Garman for Defamation and Libel. I the mean time it rally doen't matter what any of you state here because ultimately it is Marc, who signed his name to this article, who will have to answer the call.
